1. Seller information

This website, atelierdeauville.com, operates under the trading name Atelier Deauville.

By accessing, browsing or placing an order through Atelier Deauville, you agree to these Terms & Conditions, our Privacy Policy and the other policies published on our website.

2. Scope

These Terms apply to purchases made through Atelier Deauville by consumers and users.

We ship to France and the European Union, the United Kingdom, the United States, Canada, Australia and New Zealand, and Mexico, Chile and Colombia, provided that the destination is available at checkout.

If you place an order from a country other than Spain, mandatory consumer-protection rules in your country of residence may apply. Nothing in these Terms limits any legal rights that apply to you.

3. Age and website use

You must be of legal age to enter into a contract in your country of residence in order to make a purchase. If you are under legal age, you must have the permission of a parent or legal guardian.

You agree to use the website lawfully and not to interfere with its operation, attempt unauthorised access to systems or data, or use Atelier Deauville content for unauthorised commercial purposes.

4. Products, information and availability

Atelier Deauville offers women's clothing, footwear, accessories, bags and other fashion products.

We aim to display product images, colours, measurements and descriptions as accurately as possible. However, colours may vary slightly depending on your screen, lighting, production batch or device settings.

Size guides are provided as a reference. Please review the measurements shown on each product page before placing an order. If you are unsure between two sizes, write to us and we will advise you.

Product availability may change without notice. We reserve the right to limit quantities, remove products or refuse orders in cases of stock shortages, suspected fraud, technical errors, promotional abuse or unauthorised resale activity.

5. Orders and contract formation

The display of products on the website does not constitute a binding offer to sell.

When you place an order, you submit a request to purchase. The automatic order-confirmation email confirms that we have received your request but does not necessarily mean that the sales contract has been accepted.

The sales contract is accepted when we send an express shipping confirmation or hand the order to the carrier.

We may cancel an order before shipment in the event of a clear pricing error, stock shortage, incorrect payment details, incomplete address, reasonable suspicion of fraud or breach of these Terms. In that case, any amount charged will be refunded through the original payment method, unless applicable law requires otherwise.

Once processing has started, changes or cancellations cannot be guaranteed. This does not affect any statutory withdrawal rights you may have.

6. Prices, taxes and payment

Prices are displayed in euros (EUR), inclusive of all applicable taxes. The final total will be displayed before you complete payment.

Shipping is free on all orders, to every destination we serve, with no minimum order value. No delivery charge will be applied at checkout.

We reserve the right to change our prices at any time. The applicable price is the one displayed when you confirm your order. In the event of an obvious pricing error, we will inform you and you may confirm your order at the corrected price or cancel it at no cost.

Available payment methods may include credit or debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay and instalment or deferred payment via Klarna, depending on availability in your country and at checkout.

Instalment or deferred payment is a service provided by a third party, subject to its own terms and to its approval. Atelier Deauville plays no part in granting or managing that financing.

We do not directly store complete payment-card information. Payments are processed by external payment providers. Your order is processed only once payment has been authorised.

7. Promotions, bundles and gift cards

Atelier Deauville may offer discount codes, volume discounts, buy-one-get-one offers, bundles, gift cards or other promotions.

Unless expressly stated otherwise:

Promotions cannot be combined.
Discount codes must be applied before checkout.
Promotions may be subject to specific dates, products, quantities or conditions.
We may cancel discounts obtained through fraud, technical error, abuse or breach of promotion terms.
If only part of a bundle or promotional order is returned, the refundable amount may be recalculated according to the price of the items kept.
Digital gift cards are not redeemable for cash except where required by law.
Promotions do not limit any legal rights to withdrawal, returns or remedies for defective goods.

8. Processing, shipping and delivery

Orders are normally prepared within 1 to 3 business days after payment confirmation.

Products are fulfilled and dispatched from our logistics partners and suppliers located in China. Once shipped, estimated delivery normally takes:

Mainland France: 10 to 20 business days.
European Union: 12 to 22 business days.
United Kingdom, United States, Canada: 12 to 22 business days.
Australia, New Zealand and Latin America: 12 to 25 business days.
These timeframes apply in addition to the preparation time and are estimates, not guarantees. They may be affected by customs inspections, high-demand periods, holidays, carrier issues, weather conditions, local restrictions or force majeure events.

The maximum agreed delivery time is 45 calendar days from the conclusion of the contract. If that period is exceeded, you may require us to deliver within a further reasonable period and, failing that, cancel the contract and obtain a full refund within 14 days of your request.

Where available, you will receive a tracking number. Tracking updates may take 2 to 5 business days to appear after dispatch; this is normal.

We bear the risk of loss and damage to the product until it is handed over to you.

9. Customs, import taxes and local charges

For deliveries within the European Union, no customs duties or additional import VAT will be charged to you: applicable taxes are already included in the displayed price.

Certain destinations outside the European Union may impose customs duties, import VAT, taxes, clearance fees or other local charges. Where these amounts have not been expressly collected during checkout, they are the customer's responsibility. Atelier Deauville does not control these amounts and cannot guarantee that they will not apply.

The customer is responsible for providing all information needed for delivery and for complying with their local import rules.

10. Delivery address and uncollected parcels

The customer is responsible for providing a complete, accurate and accessible delivery address.

If you notice an address error, contact us within 12 hours at atelierdeauville@outlook.com. We cannot guarantee changes once processing has started or the order has been shipped.

If an order is returned because of an incorrect address, repeated delivery failure, refusal to pay import charges, failure to collect the parcel or another reason attributable to the customer, we may offer re-shipment after the new shipping costs have been paid.

Any refund that may apply after a parcel is returned will be handled under applicable law and may take into account external costs actually incurred where legally permitted.

11. Right of withdrawal and returns

You have a statutory right of withdrawal of 14 calendar days from delivery for eligible items. If your order was delivered in several parcels, the period runs from receipt of the last item.

To exercise your withdrawal right, you must clearly notify us by email at atelierdeauville@outlook.com, including at least your name, order number and the item(s) you wish to return. You do not need to provide a reason. You may also use the model withdrawal form annexed to our Returns and Refunds Policy, although using it is not compulsory.

You must contact us before sending a return so that we can provide the correct instructions. Once your request has been reviewed and the conditions below are met, we will send you a return number and the authorised return address within 48 working hours. This does not limit any statutory rights you may have.

Do not send items to the sender address shown on the parcel or directly to a supplier without prior instructions, as this may prevent proper identification and handling of the return.

To qualify for a voluntary return, the item must be sent back within 14 days after you notify us of withdrawal and must be in suitable condition:

Unworn, unwashed, unaltered and undamaged.
With labels, accessories and included components where applicable.
Properly protected for transit.
You may inspect the product as you would in a physical shop. Where handling goes beyond what is necessary to establish the nature, characteristics and functioning of the item, a proportional reduction for loss of value may apply where permitted by law.

Unless the product is defective, incorrectly sent or materially different from its description, the direct return cost is the customer's responsibility. As our items are dispatched from a logistics centre located outside the European Union, the authorised return address may also be outside the European Union, and the cost of returning an item may represent a significant proportion of its price. We provide an estimate of that cost when we approve your return request.

For hygiene reasons, underwear, swimwear and earrings cannot be returned once unsealed. Personalised or made-to-measure items and gift cards are also excluded.

12. Refunds

Once an eligible return has been communicated and approved, we will process the refund without undue delay and, in any event, within a maximum of 14 calendar days, without prejudice to our legal right to wait until we receive the returned goods or valid proof that they have been sent back, whichever happens first.

Refunds will be made using the original payment method unless we expressly agree on another method and it does not create additional costs for the customer.

As shipping is free on all our orders, there is no initial delivery charge to refund. Any premium or express delivery service voluntarily selected by the customer is not refundable.

We do not offer direct size exchanges. If you need a different size, you must request a valid return and place a new order.

13. Defective, incorrect or non-conforming products

If you receive a defective, damaged, incorrect item, or an item that materially differs from its description or published size guide, contact us at atelierdeauville@outlook.com as soon as possible.

To speed up our review, we may request clear photos or videos of the item, label, packaging and the issue identified. This request does not limit your legal rights.

When a defect, shipping error or lack of conformity is confirmed, Atelier Deauville will cover the return shipping costs in full and the reasonable costs of the applicable solution. Depending on the circumstances and applicable law, this may include replacement, repair, price reduction or refund.

14. Statutory guarantees

All our products benefit as of right from the statutory guarantee of conformity, which lasts 2 years from delivery of the goods, and from the statutory guarantee against hidden defects.

Under the guarantee of conformity you may obtain the repair or replacement of the goods and, in the cases provided for by law, a price reduction or cancellation of the sale. During the 24 months following delivery you are not required to prove the existence of the lack of conformity.

These guarantees apply independently of any commercial warranty and at no cost to you.

15. Intellectual property

All Atelier Deauville content, including the trading name, logo, photographs, videos, text, designs, graphics, trademarks, product pages and visual elements, is protected by intellectual-property and industrial-property rights.

You may not copy, reproduce, distribute, modify, publish, commercially exploit or otherwise use this content without Atelier Deauville's prior written permission.

16. Reviews and customer content

We may allow customers to post reviews on the website. Where reviews are published, we state whether they are subject to verification and, if so, how that verification is carried out. No review is published in exchange for payment, and we do not remove a review solely because it is negative.

Customers are responsible for ensuring that their comments are truthful, respectful and do not infringe third-party rights.

We will not use customer photographs, videos or user-generated content in advertising, social-media campaigns or commercial promotions without the relevant permission.

We reserve the right to moderate or remove reviews that are fraudulent, offensive, misleading, unlawful or irrelevant.

17. Third-party services and links

The website may include third-party services, such as payment processors, tracking applications, review platforms, social-media services or external links.

Atelier Deauville does not control the policies, availability or content of such third parties. Their services are governed by their own terms and policies.

18. Limitation of liability

To the fullest extent permitted by law, Atelier Deauville is not liable for indirect damages, loss of opportunity, loss of profit, technical interruptions, carrier delays or events outside our reasonable control.

Nothing in these Terms excludes or limits consumer rights, liability that cannot legally be excluded, or obligations relating to defective or non-conforming goods.

19. Data protection

The processing of personal data is governed by our Privacy Policy. By using Atelier Deauville, you agree that we may process your data in accordance with that policy and applicable law.

20. Governing law, complaints and dispute resolution

These Terms are governed by Spanish law.

Before filing a formal complaint, we invite you to contact us at atelierdeauville@outlook.com so that we can try to resolve the issue quickly and amicably.

Consumers may also use a consumer mediation service free of charge, and may refer the matter to the European online dispute resolution platform at ec.europa.eu/consumers/odr.

This does not limit your right to contact consumer authorities, use available dispute-resolution mechanisms or bring a claim before the legally competent courts. Where consumer-protection law requires it, the courts legally competent for the consumer's domicile will apply.

21. Changes to these Terms

We may update these Terms when necessary to reflect operational, legal or service changes.

The version that applies to a purchase is the version published on the website at the time the order is placed.

22. Severability

If any provision of these Terms is held to be void or unenforceable, the remaining provisions remain in full force.
